Trailer Advertising Agreement

Xpand-Media (Pty) Ltd

AND
The Advertiser

1. Advertising

Xpand-Media will arrange for the printing and installation of advertisements on the trailer(s) purchased or rented by the Advertiser via the online store. The Advertiser must provide artwork changes at least one week in advance.
The Advertiser is entitled to advertising space on the trailer(s) as per their purchase through the online store.
The printing and wrapping costs per trailer are included in the purchase.
The contract begins once full payment has been received.
The contract duration is as selected by the Advertiser at checkout.

Insurance is an optional add-on that may be selected or declined at checkout.
If the Advertiser selects insurance, no additional printing fee will be charged in the event of vandalism or acts of God (such as wind, storms, fire, etc.).
If the Advertiser declines insurance, a printing fee will apply for any damage caused by vandalism or acts of God.

The Advertiser must pay the full amount at the time of purchase via the online store.
Payments must be made through the available payment methods on the online store (EFT, card payment, or other approved options).
Trailer rentals are paid in advance, and no credit will be provided for trailers that are off-road due to the client’s request or maintenance.

Xpand-Media may cancel this agreement by written notice if the Advertiser:
- Fails to make payment on time and remains in default for three (3) days after receiving written notice. A 10% penalty per trailer may apply, and Xpand-Media reserves the right to remove the trailer until payment is made.
- Violates any other terms of this agreement and does not correct the issue within three (3) days of written notice.

Both parties agree that any disputes will fall under the jurisdiction of the Magistrate’s Court in terms of Section 45 of the Magistrate’s Court Act 1944.
The party in breach will be responsible for all legal costs, including attorney fees, collection fees, and VAT.

No relaxation or indulgence granted by either party will waive any rights or alter the agreement’s enforceability.
This agreement cannot be changed or canceled unless both parties agree in writing. If no cancellation notice is provided at the end of the contract, it will continue on a month-to-month basis.
The person completing the purchase agrees that they are authorized to enter into this contract on behalf of the Advertiser and personally guarantee compliance with payment terms.

If the Advertiser or Service Provider terminates the contract early, 70% of the remaining contract period must be paid upfront.
